  Fellow Marines,

  While I commend you all for your desire to stand by our accused brothers and to ensure that they receive all the rights and protections they deserve, I urge you to be very very careful in your reaction not to join the fickle media by establishing an impression that if nothing is done, these men won't get a fair shake.  I for one, have complete and total faith in the Marine Corps and the UCMJ and given the high visibility that will be given to this case, I'm convinced that any and all efforts will be applied to ensure that such things as "Railroading" will not occur.

  As a "Mustang" officer who has seen both sides of the fence, I resent some of the subtle innuendos circulating that, because these men are members of the enlisted ranks, they will not receive as good a trial as would an officer.  To even suggest such a thing is an insult to our Corps.  I fear that the suggestion that we need to collect money to provide a proper defense for these men will send a similar message and might even be looked upon by some as a financial scam.

  My advice to you is. . . Keep faith in your Marine Corps and those who are running it today and don't let the Media drag you down into their pig pen to wallow with them in the mud.

      Today I joined my friend Tom Bolinder in a meeting to create a non-profit corporation. 

      Tom and I joined the Marine Corps on the buddy system. With him was another mutual friend Mark O'Reilly who served in Vietnam with Kilo 3/1. Also attending were two Marines who served in choppers, Jim Holland and Robert Gale. Dominic Spada, a severely wounded Recon Marine who has spent the post Vietnam experience with the DAV and is still helping Vets from all services. Leading the meeting was a former Marine Colonel Gerald M. Kirby an Attorney formerly a JAG. 


      By telephone, Patrick Murphy, Chief Judge of the East St. Louis Federal Court. Patrick also a former member of Kilo 3/1 and he served with O'Reilly. 


      My son, Captain Sean W. Barnes USMC 3rd Recon BN. served with 3/4 in Iraq on his second tour in Hiditha guarding the Hiditha Dam.I'm familiar with the area as a concerned Dad. 


      The events reported in Time magazine and all the media of killings at Hiditha (Kilo 3/1) disturbed me to no end. 


      I have the feeling that these young Marines are going to be "Railroaded" so the government can prove to the world that we don't tolerate "Killing Civilians". You and I know in the fog of war bad incidents happen and it's going to be the enlisted that are going to get screwed. 


      In July last, Mark O'Reilly, Judge Pat Murphy and me went to Bethesda Medical Center to visit two Marines from Kilo 3/1 that had been badly wounded by IED's in different instances. These two L/Cpl's were splendid examples of our Marines serving in Iraq and everywhere. They were and are not criminals. They are the finest! They wanted to be sent back to their units. It broke my heart to see their broken bodies. They are going home after many months of rehab. Their lives are altered, as were many of ours, for the rest of their lives. Judge Murphy said to us today that he encounters criminals' everyday he sits on the Federal bench. These young Marines are not CRIMINALS. They just want to protect their fellow Marines and STAY ALIVE! 


      This country, in WWII, bombed Dresden civilians in Germany. Bombed with Nuclear weapons on the Japanese to end WWII. 


      The purpose of this "Legal Defense Fund" is to defend those accused of "HIGH CRIMES" in a WAR ZONE, regardless of their service branch. 


      The board must be made up of individuals from all over the US. Not a big board. I need to hear from people who are interested in helping to perhaps serve on the board or to organize fund raising in their geographical area. Please indicate your ability to lend specific support to the board. (I.E. Attorney-Accountant-Fund Raising- ETC.) 


      We need a board small enough to be effective.  


      This Corporation will create a lot of controversy. Those of you with 100 % disabilities do not want to be on the board. If you are moving toward it you will not be on the board. 

      If you have family serving on active duty don't get on the board. Lots of haters exist and they will try to hurt you! 


      I need the email responses to bring to our next meeting on June 14, 2006. 


      Please understand this is a deadly serious matter.
